        The work to be carried out under this works contract comprises the permanent works (facilities and systems) related to the new Zaghloul El Bahary WWTP (15,000 m3/d; 2037) to be designed, constructed, and commissioned; the effective restoration of any defects during the 1-year Defects Liability Period; and the optional 1-year of normal operation and maintenance of the works. The contract comprises also the provision of training services to the Procuring Entity’s personnel dully completed within the defects liability period and before the works hand-over.

      4. Description of the procurement:

        The Kafr El Sheikh Water Supply and Sanitation Company have received financing from the European Investment Bank (EIB), the European Bank for Reconstruction and Development (EBRD) and the European Union toward the cost of the Kafr El Sheikh Wastewater Development Project, and intends to apply part of the proceeds to finance this works contract. The Procuring Entity invited eligible international and/or national construction firms (“Tenderers”), who are experienced in similar design-build works and O&M services under similar conditions, to indicate their interest in providing the specified design, construction and commissioning works and operation and maintenance (O&M) services.

        The examination and evaluation of Tenders was executed according to the provisions set out in the procurement documents, Instruction to Tenderers (ITT) Clauses 26 to 38. To be qualified for Contract award pursuant to Instruction to Tenderers (ITT) Clause 39, Tenderers must demonstrate that the minimum administrative compliance requirements for “Administrative Qualifications” and for “Technical Qualifications” were substantially satisfied. The evaluation to this effect was executed on a ‘Pass’ or ‘Fail’ basis. The ‘Administrative Qualifications’ requirements comprised (a) General Documentation, (b) Eligibility, (c) Historical Non-Performance and Litigation, and (d) Financial Situation. Whereas the “Technical Qualifications” requirements comprised (a) Experience (General, Specific, and ESHS Certification/Documentation and Experience), (b) Personnel, (c) Equipment, and (d) Subcontractors. Only substantially responsive tenders were subject to further evaluation of Technical Conformity and Competence.

        In addition, Tenderers must demonstrate that the minimum requirements for technical conformity and competence were substantially satisfied. The evaluation to this effect was executed based on the following criteria in decreasing order of importance:

        • Technical Solution Maximum Score: 550 Minimum Score: 400

        • Tenderers’ Performance Guarantees Maximum Score: 150 Minimum Score: 100

        • Structure and Organisation Maximum Score: 150 Minimum Score: 100

        • Personnel and Equipment Resources Maximum Score: 150 Minimum Score: 100

        Only substantially responsive tenders for technical conformity and competence were subject to evaluation of Financial Proposals. For the determination of the highest ranked combined technical and financial score, the weights applied to the technical proposal was 70% and the evaluated financial price was 30%.

        The Employer decided to award the Contract to the Tenderer whose Tender was (a) affirmatively determined to comply with the Administrative Compliance Criteria and Requirements, (b) affirmatively determined to comply with the Technical Conformity and Competence Criteria and Requirements by being substantially responsive to the procurement documents, and who had offered the lowest evaluated Tender Price and was expected to implement the Contract satisfactorily.

        Only Tenders submitted pursuant to the requirements specified in the procurement documents were considered. The evaluation was carried out solely on the information submitted in the Tenders. Any additional information not mandated by the provisions set out in the procurement documents was not considered, although the tender evaluation committee requested the Tenderers for clarifications. All procedures were carried out pursuant to the provisions of the procurement documents that had taken into consideration the EIB Guide to Procurement dated December 2018 and the FIDIC Yellow Book "Conditions of Contract for Plant and Design-Build", 1st Edition, 1999.
